Two northern Door communities will be heading to court in a dispute over who owns its local wastewater treatment plant. The Sister Bay Board of Trustees has started the process of filing a lawsuit against the Town of Liberty Grove seeking a declaratory judgment regarding ownership of the Sister Bay Wastewater Plant. The plant was built back in the 1970’s off Autumn Court in Sister Bay and still operates today. The village claims that the plant was built with the understanding that Liberty Grove owns the “capacity” in the plant, but Sister Bay has the ownership of the physical assets. The two sides have spent the last two years discussing the dispute before Sister Bay officials sought a declaratory judgment. Village Attorney Randy Nesbitt says despite it not being a money making entity, the judgment is still needed to determine who is responsible for costs related to upgrades or enlargements of the plant.
The Town of Liberty Grove met in closed session last night to discuss the lawsuit with their legal counsel during its regularly scheduled board meeting.
